Privacy Policy

iManageRent, Inc. (“iManageRent,” “us,” “we,” or “our”) is sensitive to your concerns about how we use the personal information we collect from you through our website at www.imanagerent.com  (the "Site"), through our white label users ("Portals") and other plug-ins exchanging information with us ("Applications"). The Site, Portals and Applications are sometimes collectively referred to as "Online Services" for simplicity.  We take your privacy seriously, and have implemented this privacy policy (the "Privacy Policy") and internal policies and practices to keep your personal and financial information secure. The Privacy Policy covers the Company’s treatment of the Personally Identifiable Information we collect when you use the Online Services.  It also describes the choices available to you regarding our use of your personal information and how you can access and update this information. This Privacy Policy is incorporated into our Terms of Use and our Terms of Sale, and therefore governs your use of the Online Services. By using the Online Services, you accept the terms of this Privacy Policy. 1. Children

Our Site is not intended for individuals under the age of 18. We will not knowingly collect personally identifiable information via the Site from visitors in this age group or younger.

2. What Information Do We Collect About Our Users?

We collect information manually and automatically. Access to the Site does not require any form of registration, allowing you to visit our Site without any need to provide us with your personal information. However, you may be asked to provide us personal information when you visit the Site, in order to allow us to respond to requests for information or other services you may be seeking. You will also be asked to provide us personal information when you register with our Site and set up an account and from time to time when you access your account, or otherwise use any Online Services. Information collected manually includes your name, address, telephone number, social security number, email address, demographic data, or other specifically identifiable information, and, if you have requested any payment processing services, additional information such as credit card, bank account, and other financial information.

Traffic Data. We may collect a variety of visitor data such as IP addresses, browser settings, internet service provider (ISP) information, referring/exit pages, operating systems, date/time stamps, and clickstream data (collectively "Visitor Data"). The Company’s internal servers and software automatically recognize Visitor Data. No Personally Identifiable Information is collected in this process. The Site may use Visitor Data to compile traffic data about the types of visitors who use the Site at specific intervals (collectively "Traffic Data"). For purposes of this Privacy Policy, references to a visitor of the Site also includes anyone who visits our Site, including visitors who create an account and become a user.

We may use Traffic Data to analyze Site traffic, but this information is not examined for Personally Identifiable Information. We may also use Traffic Data to diagnose problems with our server, administer our Site, or display content according to your preferences. Visitor Data and Traffic Data may also be shared with business partners, affiliates, or advertisers on an aggregated and anonymous basis.

Cookies.  We may use the standard cookie feature of major browser applications and third-party providers, or employ internally developed cookies and tracking codes, that allows us to store a small piece of data on a visitor's computer, or any other device a visitor uses to access Online Services, about his or her visit to the Site or use of Applications. We do not capture Personally Identifiable Information in cookies or use cookies to mine Personally Identifiable Information.  You can remove persistent cookies by following directions provided in your Internet browser’s “help” directory.  If you reject cookies, you may still use our site, but your ability to use some areas of our site, will be limited. Information collected automatically includes, without limitation, your domain name and host for internet access, the internet address of the site from which you came, the date and time you access the website, your computer or device’s IP address and information about its operating system, browser and host, and your geographic location. 

Web Beacons.  We employ a software technology called clear gifs (a.k.a. clear gifs), that help us track referrals from our partners and affiliates and better manage content on our site.  Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of web users.  In contrast to cookies, which are stored on a user’s computer hard drive, clear gifs are embedded invisibly on web pages and are about the size of the period at the end of this sentence. We do not tie the information gathered by clear gifs to our users’ Personally Identifiable Information.

3rd Party Tracking.  The use of tracking technologies by our service providers, technology partners or other 3rd party assets on the Site is not covered by our Privacy Policy.  These 3rd parties may use cookies, clear gifs, images, and scripts to help them better manage their content on our Site.   We do not have access to or control over these technologies.  We do not tie the information gathered to our users’ Personally Identifiable Information.

Personal Information. We require each user to provide us with personal information (collectively "Personally Identifiable Information") to access and use our Online Services and other products and services we may offer from time to time. Personally Identifiable Information is captured only when a visitor accesses Online Services, or speaks on the phone with an iManageRent representative, and willingly discloses that information. This disclosure may occur when a visitor registers with an Online Service, engages in transactions, contacts customer service, or participates in contests, promotions, surveys, forums, content submissions, requests for suggestions, or other aspects of services offered by us.

Personally Identifiable Information includes: (i) "Contact Data" (such as your name, address, city, state, zip code, phone number, and email address); (ii) "Financial Data" (such as your credit card number, expiration date, and verification code or bank account information); (iii) "Demographic Data" (such as your zip code and sex); and (iv) other "Personal Data" (such as your social security number, rental information, real and/or personal property information, financial information, marital information, trade secrets, and other sensitive information necessary to generate any documents (e.g., lease agreements, notices, etc.) or otherwise provide you with any of our services (e.g., property listing services, rent payment processing services, lease administration, etc.).

We may collect the information of 3rd party individuals or entities as necessary, such as but not limited to sending notices, billing, or receiving payments, or registering authorized contacts to access their iManageRent account.  iManageRent uses this information for the sole purpose of administering its services for our users, and does not use such information for any other reason.

Certain personal information becomes public when made available on listing sites. For example, if you should chose to list your property using property listing service, any information you decide to list will become publicly available.  Our Privacy Policy does not cover these or similar situations where you choose to make personal information publicly available.

Information about Others. By submitting personal information about others, you represent and warrant that you are authorized to do so, that you have made this statement of privacy practices available to the person about whom you supply the information, and that you have obtained that person’s consent to such statement.

Calls/Electronic Communications. In the regular course of our business, we may monitor and record phone conversations or email communications between you and our representatives for training and quality assurance purposes. We may receive a confirmation when you open or click on content in an email from us, which helps us make our communications to you more useful and interesting. If you do not wish to receive email from us, you may unsubscribe from our mailing list on any of the emails we send.

3. How Do We Use the Information We Collect and Do We Share the Information We Receive?

We use information we collect from the Online Services to communicate with you, including without limitation, to improve site functionality, help diagnose problems with our servers, to administer the Site, and to gather demographic data and website statistics, process your orders, facilitate your transactions with our third-party marketing partners, and inform you of offers and discounts. For example, you may receive an email confirming your username and password, receive communications responding to your inquiries, providing services you requested, and managing your account. We occasionally send service-related announcements to alert you to Site maintenance that could temporarily suspend or disable your access to our Site or the services we offer.

Our User’s Business Data
Our users use our Online Services to host commercially and personally sensitive information related to their businesses. That information is confidential and, in some cases, proprietary, to our users. As such, we do not review, share, distribute or reference any such information except as necessary to provide the Services in a professional manner consistent with our legal, regulatory and other obligations, and subject to our Terms of Service; and to better understand how users and other individuals access and use our Services, both on an aggregated and individualized basis, to improve our Services and respond to user desires and preferences, and for other internal research and analytical purposes.

Further, we may share certain personal information with our third party vendors if necessary to provide Services to our users. For example, all financial, credit, and billing information that we collect is used solely to check the qualifications of prospective users for various Services and, where appropriate, to bill for those Services.

We may also occasionally engage third parties to provide certain Services to our users and/or, in turn, their customers. Further, we may provide certain Services jointly with selected business partners. In such circumstances, third parties and partners are not permitted to retain, share, store or use your information for any other purpose than to deliver the relevant Service(s) in a professional manner, and consistent with their legal, regulatory and other obligations.

For clarity, we do not and will not share any personally identifiable or sensitive business information with third parties for unknown reasons.

ANONYMOUS USAGE DATA
We collect certain information about how different constituencies (e.g., our users, our users’ customers, vendors, etc.) interact with our Services on an anonymous basis. For example, we collect certain information designed to help us understand how our users manage their properties through our Online Services. In that case, the information we collect does not include information that could identify you personally. We may anonymize the information we collect about your use of our Services by removing or "hashing" any data fields (such as name, address and telephone number) that identify you or that can be used to identify you personally. We use industry best practices and state-of-the-art techniques to anonymize and aggregate data.

We aggregate information by combining anonymous data that meet certain criteria into groups. For example, we might want to know average rental prices for a particular market so as to better understand how to communicate with our property manager users and prospects in that market or so that we can communicate more broadly about market trends by region or similar issues. The resulting data aggregation would be an anonymized aggregated total that we could then share without disclosing any personal or sensitive information. For clarity, we do not and will not sell your usage data to third parties.

Email Opt Out.  We may send promotional emails and newsletters from time to time to registered users of our Site and to those who have opted in to receive such emails. Generally, you may not opt-out of service-related or transactional communications, which are not promotional. If you do not wish to receive service-related communications, you may terminate your account by contacting info@imanagerent.com or +1.415.547.0049. However, you can opt-out of promotional communications by following the unsubscribe instructions in any communication, by emailing us at info@imanagerent.com, or calling us +1.415.547.0049.

You may choose not to provide us with Personally Identifiable Information or disable the cookies in your browser by changing its settings. If you change these settings, you may continue to browse its pages. However, we will not be able to process orders or grant you access to our Online Services without Personally Identifiable Information.

Retention of Personal Information. We generally will retain information for as long as required, allowed, or as we believe it useful. If you cease using the Site, terminate your user account with us, or your permission to use the Site is terminated, we may continue to use and disclose your personal information in accordance with our privacy practices as amended from time to time. We do not undertake retention obligations through this statement. We may dispose of information in our discretion without notice, subject to applicable law.

4. We share user information with third parties as follows:

Processing Orders. We, sometimes with the assistance of a third party or one or our affiliates, may use your Personally Identifiable Information to process payments through merchant account services, and to generate the products and services you order.  Your Contact Data may be used to follow up with you on transactions you initiate through our Online Services, responding to inquiries made through Online Services, inform you of changes to our Online Services, and send you additional information about iManageRent and its products and services (unless you have otherwise opted out of receiving such communications). These third parties may have their own online terms of use and privacy policies, which may apply to you.  Please contact us for more information about our current practices.

Required by Law. We may also disclose your personal information: as required by law, such as in response to a subpoena or similar legal process, and when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a legal request.

Visitor Demographics. Contact Data and Traffic Data are used to gather general statistics about our visitors and users. We may use Demographic Data to generate collective information about our visitors and users, but not in a way that identifies any visitor or user specifically. For example, we may inform third parties about the number of registered users and unique visitors, and the pages most frequently browsed.

Service Providers. We may share your Personally Identifiable Information with companies that provide support services to us (such as a printer or email service providers, merchant banking service providers, payment processing service providers, etc.), or help us market our products and services. These companies may need information about you in order to perform their functions. These companies are not authorized to use the information we share with them for any other purpose.

Partner and Affiliate Tracking. Our partners and affiliates may use cookies and web beacons to collect non-personally identifiable information about your activities on our Site and other websites to provide you targeted advertising based upon your interests. If you would like to learn more about online display advertising, please visit the Networking Advertising Initiative at www.networkadvertising.org/managing/opt_out.asp or the Digital Advertising Alliance at http://aboutads.info/choices.  Please note this does not opt you out of being served advertising.  You will continue to receive generic ads. If you delete your cookies, use a different browser, or buy a new computer, you will need to renew your online display advertising opt-out choice.  We do not currently allow visitors or users to opt-out of our site’s tracking signals or mechanisms which allow us to track your online behavior.

Property Listing and Service Provider Communication Features. Our Online Applications offers our users several features which include assistance with listing your property on various third party websites such as Craigslist, Google, oodle, Trulia, Lovely, apartmentlist, among others, as well as the ability to communicate with your services providers (e.g., electricians, plumbers, etc.). You should be aware that any information you provide in these areas may be read, collected, and used by others who access them.  You should use caution when deciding whether to disclose your personal information in these areas of the Site, when listing your property using third party websites, or communicating with service providers. Other Transfers. We may share Personally Identifiable Information and other data with businesses controlling, controlled by, or under common control with us. If iManageRent is merged, acquired, or sold, or if some or all of our assets or equity are transferred, we may disclose or transfer Personally Identifiable Information and other data in connection with the associated transactions.

5. Links

Third-Party Websites. We may maintain links to other websites and other websites may maintain links to the Online Services. This Privacy Policy applies only to iManageRent and not to other websites accessible from our Site or that you use to access our Site, each of which may have privacy policies materially different from this Privacy Policy. If you visit other websites, we are not responsible for the privacy practices or content of those sites. It is your responsibility to review the privacy policies of other websites to confirm that you understand and agree with them.

6. Accessing and Changing Your Account

User and Authorized Contact Access to Order Information. We will give you, or anyone listed as an authorized contact for your account, information about your account or a particular rental property. This may include information about the nature and status of your account, information you provided to process your order, payment information, and contact information. If you want someone to have access to your account, you must list them as an authorized contact or they may not obtain information about your account. You can confirm who is listed as an authorized contact for your account, add new authorized contacts, or remove authorized contacts by clicking first on "My Account," and then on "Account Information." We may send a confirmation email to your authorized contact(s), alerting them that they have been added as an authorized contact. Be aware that some products or features of our Site may require us to provide information about your account to other individuals. User Access to and Ability to Update Personally Identifiable Information. You may visit your personal account profile at any time by clicking on the "My Account" link, which will take you to the following URL: www.imanagement.com. Through My Account, you may: (i) review and update your Contact Data, Financial Data, Demographic Data, or other Personal Data and (iii) upgrade your account to allow you access to more features.  If you no longer desire our services, or if you want to remove your Personally Identifiable Information from our Site, you may terminate your account by contacting Customer Care at info@imanagerent.com or +1.415.547.0049. We will respond to your request as soon as commercially reasonable.

Data Retention. At minimum, we will retain your information for as long as needed to provide you services, and as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.  We may maintain some or all of this data in its archives even after it has been removed from the Site.

7. European Union General Data Protection Regulation

We exclusively market and sell our Services to United States-based organizations and individuals. Even though we do not intentionally collect information about residents of the European Union ("EU"), some EU residents' data may be inadvertently collected through marketing channels or by virtue of our users’ legitimate use of our Services. Collection and storage of any EU resident's data by us is minimal and incidental. No such data is used for marketing or any other purpose.

Further, we do not intentionally collect information on individuals under 18 years of age, regardless of their residency. Incidental exposure to this information may be possible if, for example, our users upload this information to one of our Services or it is inadvertently captured by our marketing organization.

Notwithstanding the foregoing, if you are an EU resident and would like to request that your data be securely removed from our systems, however collected, please send an email with proof of EU residency to info@imanagerent.com. We will remove all relevant data, so long as that removal is technically feasible, does not impact the legitimate accounting or business practices of our users, and does not violate other regulatory or legal standards with which we must comply. We will also cooperate with our users in good faith to address any requests they receive or that may impact them directly.

8. How Secure Is the Personal Information We Collect?

Our Commitment to Data Security. We attempt to make certain that our servers and connections incorporate sufficient encryption and security devices. We have implemented physical, electronic, and managerial procedures to safeguard and secure the information we collect. Credit card and personal information are transmitted by secure servers (SSL). Unfortunately, we cannot guarantee 100% security on all data transmissions. Therefore, cannot guarantee the security of information you transmit to or from the Site, Applications, or through the use of our services. You provide this information at your own risk. ACCORDINGLY, WE DISCLAIM LIABILITY FOR THE THEFT, LOSS, OR INTERCEPTION OF, OR UNAUTHORIZED ACCESS OR DAMAGE TO, YOUR DATA OR COMMUNICATIONS BY USING THE SITE, APPLICATIONS, AND OUR SERVICES. YOU ACKNOWLEDGE THAT YOU UNDERSTAND AND ASSUME THESE RISKS.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Site, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Internet like when you post property listings. The information you share in public areas of the Internet or through other websites may be viewed by any user of the Internet or the other website.

Enforcement. We periodically review this Privacy Policy and our compliance with it to verify that both are accurate and functioning properly. Please contact us with any concerns.  We will investigate and attempt to resolve any complaints and disputes about our privacy practices.

Changes to this Policy. We may update this Privacy Policy to reflect changes to our information practices. If we make any material changes a notice will be posted on this page along with the updated Privacy Policy. We encourage you to periodically review this page for the latest information on our privacy practices.  Your continued use of the Site following any updates to our Privacy Policy will constitute your acceptance of the updated Privacy Policy.

If we changes any part of the services we offer, which we may do in our sole discretion, you acknowledge that you may not be able to access, view, or use such services in the same manner as prior to such changes, and you agree that we shall have no liability to you in such case.
